Terms of sale
Purpose
These terms apply to subscriptions to Timbre, the voice note-taking app for Android published by Auzzhh, entreprise Kaltech, SIRET 10289802000015 (see the legal notice).
The trial
Ten minutes are offered with every feature when you create your account. The trial is given once per Google account and per device: a device that has already had it does not reopen it, even with another account. The decision is made the first time the account signs in, and it does not change afterwards. If you delete your account, the trial does not come back for twelve months.
Fair use
The trial is offered once. Opening several accounts to get it several times, sharing an account between several people, automating requests or getting around Google Play checks is forbidden. It is also forbidden to decompile, disassemble or analyze the code of the app, to change how it works, or to use tools that do so for you.
When we find such a practice, we may suspend the account, refuse it the trial, refuse to sell it a subscription or, as a last resort, delete the account. A suspended account can no longer sign in; you can write to us at the contact address below to contest it, and we answer before deciding what happens next. A running subscription stays managed by Google Play: it is cancelled from the Play Store. Suspension does not stop it: as long as you have not cancelled it, Google keeps charging it, and we may refund the current period.
The tiers
The subscription is monthly. Each tier gives a number of minutes per month:
- Essential: 60 minutes;
- Pro: 180 minutes;
- Intensive: 600 minutes.
Prices are the ones Google Play shows at the time of purchase, in your currency. Where the law requires it (in the United Kingdom, for example), taxes are included in that price; in the United States, sales tax may be added at checkout. One dictated minute counts as one minute; summarizing and analyzing a note also use up minutes. Unused minutes do not carry over to the next month.
Text while you speak
During a dictation, the app can show the text as you speak (the live preview). The preview uses minutes, on top of those of the dictation.
You can turn it off in the app settings (Notes, “See the text while I speak”): only the dictation is then counted.
Subscription and payment
You subscribe from the app, and Google Play collects the payment with the method saved on your Google account. The subscription renews every month until it is cancelled. Changing tier is also done in Google Play, under its rules.
To limit abuse, the minutes of a first subscription and those added by a change of tier open up gradually over 48 hours; the app then shows “Verification in progress”. After that, the whole allowance is available.
Cancellation
The subscription has no commitment. You cancel it in Google Play, under Payments and subscriptions, then Subscriptions. Cancellation takes effect at the end of the current, already paid period: until then, your minutes stay usable. On its own it does not give a refund of that period (for withdrawal and refunds, see Right of withdrawal). Uninstalling the app or deleting your account does not cancel the subscription.
A period lasts one month from the date of subscription, not the calendar month: if you subscribed on the 12th, the subscription renews on the 12th of each month. Google Play sets these dates. A subscription made on the 29th, 30th or 31st renews earlier in shorter months, and keeps that date afterwards.
Right of withdrawal
Subscriptions are bought on Google Play. The Google Play terms apply, in particular for withdrawal and refunds.
Allowance used up
When the month’s allowance is used up, transcription, summaries and analysis stop. You can keep recording: your dictations are kept on the phone and are sent by themselves when the allowance renews, or as soon as you move to a higher tier, within the minutes already unlocked (see Subscription and payment).
Without a subscription
After the trial or after a cancellation, your notes stay on your phone. You can still read, search, edit and export them.
Refunds
Google Play collects the payment: refund requests follow its rules, and are made from your Google Play account.
Deleting your account
You can delete your account at any time, from the app or by writing to the publisher. The Delete my account page says what is erased and what remains. Deleting the account does not stop a running subscription, which is cancelled in Google Play.
